1. Service Description
Pholio Publisher (“the Service”) is a web-based authoring and publishing tool operated by Harpy I.T. Solutions Inc. (“we,” “us,” “our”). The Service enables users to create, edit, and export books in PDF and EPUB formats suitable for self-publishing platforms such as Amazon KDP and Draft2Digital.
2. Account Terms
You must be at least 16 years old to use the Service. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must provide a valid email address during registration.
3. Your Content
You retain full ownership of all content you create, upload, or import into the Service, including manuscripts, images, cover art, and project files (“Your Content”). By using the Service, you grant us a limited, non-exclusive license to process, store, and display Your Content solely for the purpose of providing the Service to you. We do not claim ownership of Your Content and will not use it for any purpose other than operating the Service.
4. Acceptable Use
You agree not to use the Service to:
- Upload or distribute content that infringes on the intellectual property rights of others
- Create, store, or distribute illegal content
- Abuse, harass, or harm other users or third parties
- Attempt to gain unauthorized access to the Service or its systems
- Interfere with or disrupt the Service's operation
5. Subscriptions and Billing
The Service offers free and paid subscription tiers. Paid subscriptions are billed through Stripe. By subscribing to a paid tier, you authorize recurring charges to your payment method. You may cancel at any time through your account settings or the Stripe billing portal; access to paid features continues until the end of your current billing period.

6. Service Availability
We strive to maintain the Service's availability but do not guarantee uninterrupted access. The Service is provided on an “as is” and “as available” basis. We may perform maintenance, updates, or modifications that temporarily affect availability.
7. Limitation of Liability
To the maximum extent permitted by law, our total liability for any claims arising from or related to the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of data or lost profits.
8. Copyright Complaints (DMCA)
If you believe content on the Service infringes your copyright, please contact us at the address below with: (a) identification of the copyrighted work, (b) identification of the infringing material and its location on the Service, (c) your contact information, (d) a statement of good faith belief that the use is not authorized, and (e) a statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner.
9. Termination
You may close your account at any time through your account settings. We may suspend or terminate your account if you violate these terms. Upon termination, your right to use the Service ceases. We will retain your data for 30 days after account closure to allow recovery; after that period, your data will be permanently deleted per our Privacy Policy.
10. Governing Law
These terms are governed by the laws of the State of Maryland, United States. Any disputes will be resolved in the courts of Maryland. If any provision of these terms is found unenforceable, the remaining provisions remain in effect.
11. Changes to Terms
We may update these terms from time to time. Material changes will be communicated via the email address associated with your account at least 30 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the revised terms.
